Do I Have To Involve A Realtor In My Rent To Own Agreement ...

Q: A Realtor showed us a house but we can not get a loan and there was no buyers agent agreement. Found out we know the owners and they asked if we would like to rent the house then possibly buy it later. do we have to involve him? I do not want to do something illegal. Hillsboro, MO

A: If there was no buyer agency agreement, you do not have an obligation to involve the Realtor, in my opinion. Even if you did sign a buyer agency agreement, your inability to get a loan may make it a moot point ? you can?t buy the house. The Realtor may have had an agreement with the owners of the house, but that should not affect you. I suggest consulting with an attorney before signing a rent-to-own contract. It would be a ?cleaner? transaction if you just rent for now, then enter into a purchase contract when you are ready to buy.

A: In my opinion you should involve the Realtor if he/she has been showing you multiple properties & has been working on your behalf. It is the right thing to do since the Realtor has been spending their time with you.

A: In Real Estate agency relationships, an ?implied? agency happens when you request services of a licensed Realtor. Since your agent already showed you the home, why not Lease with Option using your agent?
